TBG Criminal Law

All Major Felonies
Whether you are the target of a criminal investigation or you have been formally charged with a crime, there is no more important decision than who you select as your legal representative, and when. It could well be the most important decision of your life. It is in your absolute best interest to make that decision as early in the process as possible. At The Berry Group, we have the resources and relationships to restore your peace of mind through respect, reason and results.

Weapons Offenses
Few people know that, in the State of Maine, possession of certain weapons during the commission of another separate crime is considered an aggravating circumstance, often requiring the imposition of mandatory minimum jail time. For example, if you are charged with reckless conduct, which in ordinary circumstances would be a misdemeanor, but you are alleged to have used a firearm, the mandatory minimum term of incarceration is one year in prison. At The Berry Group, we understand how unfairly the law can be applied, and we encourage you to consult with us immediately if you are alleged to have possessed a firearm or other weapon during the commission of a crime.

Drug Crimes
Long ago, the government decided to spare no expense in the war on drugs. The Berry Group has extensive experience in this fight. We remain diligent in providing superior legal services against overzealous prosecutions. From trafficking to possession, we begin building your defense immediately during your initial consultation. We ensure police policies and procedures are followed, that your legal rights are respected, and we set out to secure the most favorable result for you.

Domestic Violence
Maine has delivered the message that it will not tolerate domestic violence and has invented new crimes, increased jail sentences, and diminished the opportunities of the accused to defend themselves in the absence of a zealous legal advocate. Here, more than any of our other cases, The Berry Group recognizes that our client-centered dispute resolution model is critical. In other words, we know how important it is for you to be heard and given a fair opportunity to defend yourself.

Motor Vehicle/OUI
It has long been the case that the State of Maine has some of the strictest OUI laws in the nation for alcohol, and lawmakers have now turned their attention to operating under the influence of drugs. At The Berry Group, we know how damaging an OUI arrest can be: the threat to your license, your job, and incarceration can place an enormous strain on you. The police are well-trained to build a case against you built on scientific assumptions. We are trained to test their assumptions and protocols. If you have been arrested for an OUI or OUI-Drugs, it is your right to defend yourself against the allegations and to mitigate the fallout.

Arraignment noun The first court appearance of a person accused of a crime. The person is advised of his or her rights by a judge. • • • ORIGIN from Latin arrationare meaning ‘to address to call before court.’
